Thanks for all the helpful information! Here is more info per some of your questions. It is A LOT, I must try to be brief: I am a 54 yr old woman, so I would be protected under the government's age laws. I referred to FMLA to show that is the ONLY reason they would know about my health, even though it has resulted in physical changes in me, I am a very private person, and hv tried hard NOT to allow my health to affect my job. I did not talk about it. The Fmla was due to the fact that I have so many different doctors, so many regular doctor's appt's, I was able to use Fmla for time off for appointments, once my work benefit time ran out, it is considered 'intermittent'. It also states I must at times be off due to 'flare ups' of one of my condition(s), and that while I am able to perform my regular job, clerical duties, my day could be affected by the condition(s), and/or the side-effects of the meds. I have done quality work, I have reviews to prove it. I have never been written up. My past supervisor was hard, but fair, she never held back. If I did not do a good job, I would know about it. I hate to say this, DID NOT want TO SAY IT, but this lady is motivated by PREJUDICE, the new supervisor. She has ME ONLY on production, the others are treated as professionals, can work at their leisure.

So What Happened?

I have called and left msgs for two attorneys so far, thanks to you ladies!!! Hope I hear from one soon! My boss is on vacation until Monday, I am sure when she returns she will ask me if I have signed the form. When she 1st gave it to me, I did at least have the good sense to tell her I need to hold off on signing it because I had to look into a few things 1st. I was, and have been throughout, very polite and respectful. I have been able to tell she tries to antagonize me, hoping I will lose it, then she can terminate me for 'insubordination', I suppose. Also, mind you, she NEVER attacks me unless it is just her, myself, and my 2 co-workers, her drinking buddies. I think she has it worked out that they will support whatever she says happened. This is all so juvenile! THANKS!tHNKA

I would say first off, IF you don't want to be singled out because you have a medical issue, then, you shouldn't start suggesting that your employer is prejudice.. Because by doing that, it's a BIG statement and unless you have true non-biased proof, I would stop throwing that word around. In turn, IF you truly feel you have been wronged , then begin to document each situation.. Also, you state you have good reviews to prove your good work, then ok, that Is a good thing. You have some proof in the pudding. But do realize, this new supervisor still needs to see how you currently work. Also, the supervisor being NEW to the role, could be this lady's A@@ is on the line if the job overall isn't completed. Sometimes, things aren't as personal as we like to think. Again, IF you have actual , factual proof.. then write it down and DO report it..

Have you looked for a lawyer yet this afternoon to call about this letter you are supposed to sign? I really think that you HAVE to get advice from a lawyer. We can give you opinions here, but if you go by our opinions instead of legally correct knowledge, you could really hurt yourself.

Honest to goodness, you have to act fast. Get on the phone and figure out who to call. Knowing how to handle this letter is the first thing you must do RIGHT.

In the end you live and work in an at will state. They can fire you for any reason. The only way you could fight it would be to prove it was for your age and that is difficult.

The best advice I can give you is find an attorney. If they won't take your case without a retainer then you have no case. Personal injury lawyers work without retainers, if they ask for one it is because they know it is a losing case. I hope that makes sense.
