Visitation Rights for Dad

I was wondering if anyone knows where and how we can get the ball rolling on visitation rights? My boyfriends ex up and left to NJ with their son 3 months ago. She denied him a DNA test before she left. She also has yet to keep up with her promises of bringing him back to MN to visit. (Her whole family is also here) He has sent some money to her. Where can we go to look for a low income lawyer in MN and where do we start? We're worried that she's going to come after him once she's a legal citizen of NJ. (then he'd have to go out there to fight for rights and we'd rather her have to come here) PLEASE HELP!!!! Thanks a TON!!!

See a family law attorney. Many good lawyers offer a first time consultation for free. You can also do most of the paper work and paper running yourself to save cost. Speak with a lawyer who is willing to engage in collaborative process.

Meanwhile he could go to visit his child. It's a lot easier for a single guy to travel than a mom and child. I know I would cross oceans to be near my child, no matter the cost or inconvenience.

If he is not paying child support on a regular and mutually agreed on basis his case will be compromised.

Does your boyfriend doubt that he is the child's father? If so, then you need to get to Legal aid or an attorney and get the test done.........since she took off, I'm guessing he might not be the father, but if he is, he needs to get this rolling now.......

Be sure to track everything he has done in a journal.........calls made, money sent, calls she has made, what was said, etc........so when you go to court, you have dates and times that you did things........this is important.........so record them properly, good and bad.......

Did she list him as the birth father on the birth certificate? If so this can help him fight to see the child till the DNA test is done. Where I life you can go to the social service office and they will point you in the right direction. They will order DNA testing, work out child support and everything. Oh do not send cash to her. He needs to send it in a check where she has to cash it, some way where he has it noted when and how much he sent.

I suggest contacting Legal Aid to ask for help. You can also call or go to your county's family court and ask what papers to file to ensure visitation or parenting time.
