Too Much Noise

I am really going crazy. Across the street my neighbors son has a garage band. They play drums, guitar, and some kind of screaming singing. It is so horrible. They will play for hours at a time. I get such bad headaches. If I am outside with my son he can't hear me talk it is so loud. We live outside the city limits so the cops will not so anything about it. When we first moved in the other neighbor made an agreement with the mother he needs to stop playing at 8pm. But he still plays for like 4 hours at a time. I hear in side my house and it get so bad. The worst is he doesn't sing, he is yelling and screaming. What do I do? And I have checked into it there is no noise limit outside living out here!

So What Happened?

So far the music continues. I called the HOA and they said they could write a letter and just ASK them to stop and keep it to a min. Then I called the Sheriffs Dept. and they said the same thing. That they could ask them to lower it etc. But outside the city limits there is no regulations on loud music. So I am thinking about getting all the neighbors together to sign a letter and give it to the mother and she will see everyone is bothers by it. We will see!

i'm not sure how it works outside city limits, but i know that in most cities, noise that can be heard more than 30ft. away from it's source is illegal! you should go online to your county's website and see if they have the codes for such violations. if not, call the sheriff's office and ask them what the protocol is on the issue. i'm sure they would be able to help you. good luck!

Hi B.-

Have you spoken to his mother about this? It sounds like his mother was reasonable about this with the other neighbor since they were able to work out a compromise on how late he played. Perhaps if you spoke to her you could arrange for him to play at certain times during the day and for a shorter length of time. Also, is the garage door closed? Perhaps you could ask them to do that as well to cut down on the noise.

Have you tried calling the sheriff department since it would fall in their jurisdiction? The city cops obviously wouldn't, but you should be able to call the county sheriff and have them come out.

Thats what I would do.

edit: if the county sheriff won't do anything, try the constable, they are more powerful than the sheriff and city cops, jurisdiction wise.

I'm not an expert as far as the law is concerned, however, I dont think it matters if you live in the city limits or not. Noise pollution is noise pollution. I was always under the impression that 10 pm is the so-called "cut off time" for loud parties, bands, etc.
My advice, no matter what you decide, it to document. If push comes to shove with law inforcement, I would think it might behoove you to let them know exactly when and how long this problem has been going on. Also, maybe other neighbors are just as frustrated by this. Perhaps knocking on a door or two may give you enough back-up to nip this in the bud. You might even go so far as to record this noise on a camcoder or digital camera to be able to prove just how loud it is in your home.
Noone deserves to live like that, and I certainly wouldnt allow some "screaming punks" to dictate how peaceful I am allowed to live in my own home.

Maybe if you talked to the mother and son, you could work it out. Could it be agreed that he plays only at certain times, on a schedule? Then you could arrange to do your grocery shopping, errand running, visiting with friends, or whatever for at least part of that time. You would probably still have to deal with the noise sometimes, but it might help at least a little.

Sorry, this is a tough one. Really, though, I think the only thing you can do is move. He has every right to play music, and it is pretty accomodating if he stops before 8 p.m.

It does sound very unpleasant. I think there is a special place in Heaven for parents of young musicians, especially screamers and drummers. Maybe neighbors should get in, too.

I used to live next door to a Tejano band who would practice until 2 or 3 in the morning, I had class at 7:30. The cops did nothing in that case, so I do know what you're going through. I just don't think there is anything you can do about it.

Hopefully all the practice will make them better!

We also live outside the city limits and the sherriffs office comes out here and shuts down that sort of thing. Also, do you have a homeowners association? They could stop it. If all else fails, there is always court, if you feel driven to that extreme. Good luck.
