My 5th grader got jumped in the school yard but 3older kids that didn't go to his school he's very scared to go to School can I bring a case against the school for not protecting my son in school

What can I do next?

So What Happened?

I called the police and pressed charges but my baby is 11 years old and the guys that did it was,19,17,16. But its always someone from my son school out there cause they get bused to school and in talking bout kids that don't even belong no where at my son school these are men I'm talking bout

ah, the ongoing shrieks to sue. because spending taxpayer money is always a great solution to individual problems, and everything can be settled by lawyers with fat briefcases.
there's not nearly enough information there to give an informed answer. but the very fact that your first instinct is to sue tells me where your priorities lie.

for every child that is beaten up at school(and it gets reported!)
there are DOZENS of CASES that get quickly swept under the rug by teachers and administrators,

Call the police for sure and file a report, and definitely notifiy the school if this happend during the school day. Was this during recess or gym? If so, where was the teacher? He is supposed to be safe during the day, so there may be an issue for the school if this happend under a teacher's watch.

If this was an afterschool thing, you may not have much of a case. But it can't hurt to let them know what happend.

Was school in session or not?

If these were kids who were not students at the school, I don't know what your options are - you could talk to someone at the school first and see what they have to say, but you might have to go to the police and see if there is anyway to identify the boys that did this and possibly file charges against them.

Depends on the situation. Did the school have all safe guards in place and the incident still happened? Only if the school staff dropped the ball would you have a case. Call a lawyer and give full details and see what they say. Be sure the school is notified and full safety measures are in place immediately before it happens to someone else.

that is awful ! I would report to the police. I am not sure what school can do if it was outside school, off property, and not kids from there.

Possibly, but you really need to go up the chain of command first -- report the case to the principal, the superintendent, and the local police. If all of the above are unresponsive, you might have a case, maybe, but you've got to take this one step at a time.
