Need Advice Re. Damage to Home from Golfers

HI. We live on a golf course and are in the unfortunate position of being in front of a hole that most golfers miss and their balls land in our back yard. Even more unfortunately, we now have many holes in the back of our house and two broken windows. This past weekend we caught the golfer who broke our window and got his info so he could pay to have it replaced. Now he says that he spoke with a lawyer and that homeowners who live on golf courses assume all responsibility for damages incurred. I know the golf course isn't liable, but don't golfers have responsibility for damages that they incurr? Can anyone advise us on what to do? I'd really appreciate it! Thanks.

I've always been told that the golfer is responsible for all broken windows. I don't think you can do anything about the holes in the side of the house. Some courses offer insurance that you can purchase which will cover the cost of any windows broken that day.
I heard one couple in CA had 3 broken windows. Two of the people did not give her anything and the 3rd person split the cost with them, which didn't make sense to me. Most home owners end up paying for the windows even though it should not be there responsibility.
Many people feel, if you live on the golf course, you should expect this to happen,but it is too bad when it does. I wish you luck and hope you can get some insurance to cover future issues.

That sounds terrible! I could not believe it, so I put the question to Google and got a few returns.
http://www.homesalenews.com/real-estate-law/20050324.htm - says that this is part of life for living at a golf course
http://www.golfcourserealty.com/features/golf-course-home... - says that the homeowners insurance should cover it and that there should be no extra premium for this.
I would call your insurance and find out. To prevent future damage, are there options around putting up trees or nets to slow the balls down?
What about your kids in the backyard? Could they get hit if they play there?

Dear A.,

The golfer is correct in his statement that you the homeowners are financially responsible for the damages to your home and here is why...when you buy a golf course home your homeowners insurance policy covers the damages to your home by errant golf balls. This includes broken windows.
I advise you to check with your homeowners insurance agent to verify this. Many homeowners do not realize that they are covered for this protection.
Being a realtor in the golf course capital of the country...Phoenix, I have encountered this problem many times.
Again please check with your homeowners insurance agent for verification as there may be some exclusions depending on the company you are with.

I would check with your homeowner's insurance holder. I know that if a golf ball hits property, ie a passing car, then the golfer is responsible. My husband is an avid golfer and just commented that a golfer is responsible for their shots.
