My Sister Needs Help!!

My sister has twin girls from this guy she met up here in Atlanta, Ga. and now he has moved to Florida with his dad who is hordeing his Social Security checks so that the twins can't get any child support from him. Is it possible to get those babies some childsupport from a local office since he is on Social Security? They say you can't get any money or make a guy pay childsupport if he is on Social Security, is that true? She has already filed for child support and they said that "they have reserved all finacial needs", what does that mean? They already know the kids are his because they did a DNA test on him already. He is in the state of Flordia and she is here in the state of Georgia. They are 5 yrs. old and so cute and I feel bad their dad abandoned them that way..what should she do. The dad has cerebral palsey but acts and looks just fine to me. He knows what he did to my poor sister. Please help..

even though they don't live with him, they would get it if he's on the SSDI and not SSI. i'm on SSDI myself, and when my son's born, he's going to get 1/2 of mine (even if myhusband and i were to divorce and he lived with him, he would still get it). he can't get out of responsibility just because he's disabled...

She may even even be able to have the money sent directly too her. She needs to get the courts involved.

I have been on social security disability for a few years and both my girls receive a monthly benefit thru mine. Combined it is about 1/2 of what I receive so I don't understand why that's not being done. Unless it already is. All he would've needed for the two of the girls would've been their d/o/b's & ss#'s. Good luck!

Ha. Not only CAN she collect child support... but is some cases SS will pay out a lump sum for unpaid back support.

She needs a lawyer and to take him to court. In that order.

If she tried with the SSI office and they told her no, I would consider getting a lawyer, at least for a consult. My brother was on disability and his ex was sent a check every month for his kids from SS.

I don't have the complete answer but if he is on SSI (Supplemental income, usually people that haven't worked or paid enough in to be covered by SSDI) then no. If he is on SSDI (Disability), I know that children that live with the parent getting the SSDI get benefits. These benefits are called axillary payments. The amount of them is 1/2 of what he gets and it wound be divided among the children. So if he got $1000 then the kids would get $500 to be split between all kids. Since they don't live with him, I don't know if they are entitled or not. She can call the 1-800-772-1213 (Social Security) and talk to them about it. If they are entitled to it, she will get back benefits for them. She can always schedule an appointment with her SS office but if they aren't married, they won't be able to give her any information. She needs to look into getting a lawyer that specializes in social security disability--the consultations are always free and that would answer her question.
