Looking for Less Expensive Way to Divorce

Due to circumstances beyond my control, I need to get divorced. My husband has racked up lots of credit card debt that he was hiding from me (he even got a P.O. Box so the statements wouldn't come to our house). With the economy the way it is, I am scared to spend lots of money on anything. The lawyers I've talked to want anywhere from $5,000 - $10,000 TO START!! I wondered if anyone knows of a way to do at least most of it without lawyers. We don't have any property other than the ho use, which will be impossible to sell right now. I'm just looking for a way to get myself untangled from all of his junk without putting myself into major debt in the process.

One thing you can do to start is get a free session with an attorney to see how much responsibility you have for your husband's debt. divorcing may not remove you from any current debt, though it will remove your from future debt. Also see if the company you work for has an EAP (Employee Assistance Program) program. It is a free service that gives you at least 3 sessions with a counselor, and I'd suggest asking for one who specializes more in the legal and financial area, not marital. A divorce mediator can help at a much cheaper cost to get through the planning and paperwork of divorce. I live in the Crystal Lake area and have two contacts here if you live near by....just email me. If you do have any desire to stay with your husband, or even if not, I strongly suggest you encourage him to get counseling for spending addiction and/or go to Debtors Annonymous which is a free Twelve Step program. Go online to get the location of the closest one. You might want to go to Alanon or see if there is a Debtanon, which are for spouses or family of addicts, also free. There's alot of opportunity for growth and waking up to new insights about yourself in all of this. My heart is with you.

Not that I've personnally looked into this, but have thought about. You can go directly to the DuPage County Courthouse and fill out the papers yourself. My mom's friend did that.

When I got divorced I only used one lawyer. One person has to file, so that could be you. It's much cheaper if you settle everything yourself. My lawyer drafted up everything and so long as my ex agreed (which he did) then my lawyer represented me in court and that was it. I don't recall how much, but it certainly wasn't thousands of dollars.

My now husband used some kind of public service to divorce which I think might have been cheaper than my route. When he gets home I'll ask him. They had a child, and that was settled quite quickly.

It's less expensive if you can sort things out yourself on who gets what. What's expensive is if you start fighting and then your lawyer has to sort it out against his lawyer. If you agree, one laywer is enough to just get everything written up legally and signed by the both of you.
