My husband and i are seperated but still married. my daughter put him in a nursing home when his unemployment ran out but now that he get social security she wants to take him out of the nursing home to get his social security check. she lives in a 2 bedroom apartment with 3 other people plus my husband. she only wants his money what can i do to stop this and keep him in the nursing home. the people she live with also smoke pot please help me. i know we are seperated but i want what is best for him.

If she has power of attorney you would have to get a lawyer possibly. If he is cohirent enough talk to him. If she does not have power of attorney over him I would say you are still next of kin and could contest it. You stil may have to get a lawer for that. I would talk to the nursing home as well so they can be made aware of the situation and they may even be able to help you.

Discuss this with him. Your major stumbling block is going to be that most people in nursing homes desperately want to come home ( I very have recent experience with this) even if it is not in his or her best interest. If he is agreeable, have an attorney draw up a Power of Attorney for him to sign. An attorney will explain to you how the "powers" can be limited if that is a concern for your husband. I would think if you are still married you would be considered next of kin and would be the one to make all of the medical decisions, maybe consult an attorney. Good luck!
