Unlicensed Daycare

so my question is I am a licensed daycare provider in dakota county but i have a friend who wants to be an unlicensed provider and i am un sure of the rules and laws on it is there any way for her to take 3 familys with a total of 3 kids and 1 on the way and be unlicenesd it would only be for a year or two and what are the consequences i am afraid to ask my county worker as i don't want her to get in trouble or myself in trouble i know my worker has said you can be unlicensed and take 1 family and related family with out a license but is this the law and what are the consequences if caught the familys know she would be unlicensed.

She can't do that in Dakota County or she could face charges like the previous poster said. She is also would not be covered by insurance, which is a huge risk if someone were to be injured and decided to sue and if her homeowners insurance found out they could drop her policy or really increase her insurance rates.

check the Dakota county website for the rules...
in Hennepin county you can watch up to 5 children and not need a license...

The rules/laws can be found on the Dakota County website. Don't quote me but its either a misdemeanor or felony to provide childcare for more than 1 family unlicensed. She could do a one family and a niece/nephew and be fine. I wouldn't let her get away with it, you worked hard to establish your business and gain clients and to know that a friend is doing business ilegally, is wrong. There are other consequences involved as well like injuries and sicknesses, etc.

You are only able to care for one unrelated family at a time!! Make sure she follows this, as she could get in trouble for caring for more than one family at a time (unless the family is related to her)!!

This is from the State website below, this is the same in Hennepin County as well, not sure where the person below got their information. I was previously a Licensed Provider in Hennepin County before moving to Washington County.

Subp. 3. Exclusion from licensure. Under Minnesota
Statutes, section 245A.03, the following day care situations are excluded from licensure under parts 9502.0315 to 9502.0445:

A. day care provided by a relative to only related
children; or

B. day care provided to children from a single,
unrelated family, for any length of time; or

C. day care provided for a cumulative total of less
than 30 days in any 12-month period; or

D. the exclusions contained in items A and B are
mutually exclusive.
