Two Attorneys and Little Ole Me. Would You Be Intimidated?

Whew! Is all I can say. I am a single mother with debt coming out the wahzoo and my soon to be ex showed up in court with two attorneys and his mother.

I don't know how I managed to survive, partly prayer brought me through and knowing I was there for my best interest and our daughter's best interest, but still I had to really brace myself and remain composed because I don't want to give him any ammunition!

In the end the judge took everything I countered under advisement and told his attorneys that she will get back to them after reviewing my surprise documentation. I exposed his second source of income. He lied in front of the judge and said someone put his name on the business card, and I handed her the copy. It was rather sad to see it all play out because it doesn't have to be this way.

He is trying to lower child support, paying for two attorneys, $900 rent, living large, and I am a pen stroke from filing for bankruptcy if I don't get a job and quick!!!

After, I bought myself a large fry and a coke!

This is more of a release post but would you have been intimated, or come out with everything in your fiber fighting for what's right?

So What Happened?

I got temporary orders, The judge got it right!!!!!

He has to look for 10 jobs every week and report to probation with the employer, application, details, etc. If he fails to do so he's looking at SIX months in jail and the judge put that in capital letters!

He got court-ordered anger management!!!!! YES!!!!!!! That is 2 court ordered anger managements in less than 5 years!!!!!

His mother has to undergo a suitability interview b/c she wants to supervise visits outside a visitation center. Good luck is all I can say!!!!!!!!!!! to that!!!!!!!!!!!!!!! The fact the judge ordered her to be interviewed is a red flag!

They are two ruthless bullies and it's time they are put in their place!!!!!!

Come out fightin' girl! Good for you, you have to do what is best for you and your little one. Of course when I say come out fightin' I mean in the most dignified fashion. I think that you are right not to give them any ammunition. But don't be intimidated either. Sounds like you did great, I will be praying for you, don't lose faith! God is Good!!

I would come out fighting. Even if I lost everything I don't think I would be able to sleep at night if I knew I didn't do everything in my power to do something.

So sorry about your situation. This is a bullying situation if I ever heard of one. You hang in there and it sounds like you are stronger than you think.

My husband and I have been to 2 court hearing with his ex over the last 2 years and I can't tell you how many filings for modifications we've made. I felt for a long time it was my primary job and the most stressful thing I've ever been thru. And the judge did not rule this last time in my husbands favor. His ex lied, provided false documents and witnesses actually LIED on the stand and that we couldn't PROVE were false and he even ruled that we pay all of her attoney fees. But we kept fighting because we know what is best for his daughter and will NEVER give up on our kids and will ALWAYS fight for them no matter what. Its what good parents do. I hope it goes in your favor. Good luck.

There are Legal Aid Societies in many States.
You can get an Attorney that way.
Pro-Bono.
Do a Google search.

Congrats to you:) You were in an awfully tight spot and you are in the right to fight! Just remember, these attorneys are there to make a buck off your ex. Do not feel intimidated...this is what attorneys do for a living. Most people who become lawyers are egotistical, so think of it that way. Think of yourself as your child's advocate and messenger. You are the warrior. If you do have to represent yourself, do the best you can to stand up for yourself. Be organized with your documents, be polite and dress in business attire, don't speak out of line unless instructed to by the judge, make sure you give the judge a copy of everything you have if he asks for it, and be honest. Don't try to pull a fast one over on the judge either. If you come across as honest and civilized, you'll do just fine.

Hello, I have two daughters who have been through this. The judge can usually see right through a parent trying to lower child support. The fathers of each of my grandchildren who tried this ended up paying quite a bit. One who was going to be losing his job, tried that one and the judge told him that he had until the other job had ended to find another one and made a judgement on his current pay. He was also working under the table and didn't menion that pay. However, after about a year, he stopped seeing his child and then quit paying child support. Now he has gone awol from the scene. The other grandchild was lucky enough to have a father who followed the judgement on him and continues to pay his support and to see his son (even though he could see him more). Having a lawyer doesn't really give your ex the upper hand. Bringing his mommy to court was probably to make you feel "less than".

Sounds like you did great! One of my close friends just went through something very similar. Make sure you document, document and document some more! Her Ex hardly ever saw their daughter when they split. He then filed for divorce and as soon as they went to court for the first time, complained he wasn't getting to see his daughter and that my friend was keeping her from him. What he didn't realize what that she had kept a calendar documenting every time he planned on having their daughter and whether he followed through or not. The judge, mediator and even his OWN attorney saw right through him! Her divorce took 3 years exactly to become final and I am so happy that chapter in her life has been completed.
