Yikes! Yesterday, my husband found termites in our privacy fence. We rent and are going to contact the landlord. Is the termites our problem or the landlords?

What's your contract/lease agreement say?
I'd guess it's your landlord's problem. I mean, he owns the fence and doesn't want it eaten by termites... right? But, you really should see what your contract says about repairs/damages to the property.... I would EXPECT it to say that the landlord is responsible, but who knows what it says without actually reading it...

The Landlord's.

Did YOU put up the privacy fence and the Landlord let you?
Or was this privacy fence already there when you moved in?
It is the Landlord's property.
You need to read the contract.
Tell the Landlord.
I am sure, they don't want the Termites destroying everything or even, start eating the house.

There are 2 types of Termites. Ground and air.

You do not have any legal right to make any permanent changes to someone else's property. If he agrees to let you do something about this then it needs to be in writing in case he doesn't like what you do and tries to sue you for destruction of property.

If you have stuff piled up in front of this fence that would promote termites or "give" the fence the termites then it might be determined it was your fault and designated to fix it at your own cost. But in most cases it is the land owners responsibility to make his own repairs to his property.
