You didn't mention your budget, but Legos are on sale just about everywhere right now. That's what our 10-year-old son picked out to donate to a third grade boy at another school this year.

Three of my kids (1st, 3rd & 5th grade) are still asking for beyblades, which run around $8.99 at Walmart. However, he would need the stadium to play. If he doesn't already have a stadium, then he couldn't really play with the beyblade.
They also make something called Lego hero factory. They are in the lego aisle but in foil bags. They run around $10. Basically you build this creature out of the pieces. Both my boys (1st & 3rd grade) like those.
