My mom is about to lose her home to foreclosure. She was just served with the papers on Friday. She has 10 days to respond or go to court? I am not really sure of the details. I am wondering if anyone knows of a attorney that does pro bono work in the Orlando area. My mom is the guardian of her grandson, a now 4 year old, severly disabled child, who suffered a severe brain injury from nearly drowning when he was 13 months old. Since this accident, it has taken a major emotional toll on her, with her work, her finances, and life in gereral. Any information is welcome and greatly appreciated!!!

Can you try to find a local investor that would buy the home immediately? Look for the "cash for houses" ads, etc.
Can she contact a real estate agent to try a short sale?
Maybe Legal Aid can take her right away as an emergency?
I'm sorry she is going through this.

I don't understand your question, if she cannot afford the house she should move into something she can afford, that in turn will help with all her life stresses & may release a huge burden off her shoulders. If you don't think being served was fair then proceed with finding an attorney otherwise maybe try to comfort her to tell her it's for the best & you will help her through this.

That is a tough situation to be in. Was it a notice of default or notice of sale? If its a notice of sale then she's probably 6+ mo into not paying on the mortgage and thats why she's in foreclosure. It should say how much she has to pay to get out of foreclosure (the past due amount). If she can't pay it then unfortunately there isn't anything that can be done. I don't know if you could pay it or not. Before making that kind of a decision though I would get all the facts of how far past due is she? If the loan is brought current will she have the means to stay current going forward? What is the house worth vs. what she owes? What type of loan is she in? She might have been in an option loan making minimum payments and it reset to a much higher payment than she can afford. Has she tried working with the lender to get a modification? What has she been using the mortgage payment on if she's not paying? Depending on the answers she may be better off using the mortgage payments to get in a rental and walk away from the house. Her credit is already damaged and a foreclosure won't change it much more than a severe delinquency. I wish you the best.

Has your mother called the bank? My husband works for a big bank, and I can assure you that right now, banks really don't want most people's homes - the market is bad, and they'll take a loss. Especially once someone has started to foreclose, most banks are willing to work with people to prevent that from happening. Have her call the bank immediately and explain the situation and see if she can get a reduced mortgage or some extra time to try to find the money. If the person on the phone says no, make sure you move it up the chain to a manager. This is going to mean your mother is going to have to be firm, apologetic, and practical when dealing with the bank, but it is possible that a deal could be reached. It's certainly worth a shot.

I suggest consumer credit counseling I have used them before and with her situation she probably needs them bad. I will pray for her I don't know how to help
