Oil Change at Walmart Ended up in $1300 in Repairs

Hello Mamas - want you to be aware of an experience I had at Walmart:

I recently took my car to Walmart in Frisco / Little Elm (Hwy 423 / Eldorado) for an oil change. I was told that I also needed my battery posts cleaned which I approved the service. When I got in my car, it wouldn't stay running in idle. Four and 1/2 hours later after me and my 3 and 5 year olds sat in the Auto portion of Walmart, I was told a sensor had gone bad and they were going to order a new one and put it in my car. When we went to pick up the car the next day, they told us a chain reacation must have taken place as it appeared another sensor had gone out. I told them not to work on my car anymore that I was calling a tow truck. When we came back with the tow truck, two employees were still under the hood of my car. I noticed not only in addition to the new sensor they'd installed in my car, they'd also put a new battery in it (which during my oil change, my original battery was good). According to the manager, these "employees are not mechanics". If they aren't then why did they order and install parts on my car?

We filed a claim with Walmart and have been denied which didn't surprise us. I do feel we would have a case against them in the fact that the "nonmechanics" ordered / installed a part they have no knowledge with. If anyone knows of a good attorney who would like the case, please let me know.

They should never have done any of that work. My husband is a mechanic in The Colony, and the Walmart here will send the cars to an actual auto repair shop that need anything other than a straight oil change, tires, or batteries. Don't give up on your complaints. Write or call whoever you can. They should pay for any repairs due to the damage they did (the walmart in TC does, and has...my husband has done the work where walmart picked up the bill). Unfortunately, I don't know any lawyers, but don't give up!

Hi C.

I am not an attorney, but I watch a lot of Court TV and different "Judge" shows. I think your best bet would be to file a "small claims" suit, as this would not cost you attorney fees and also sounds like a typical case for it. Walmart has to respond, and may just "settle" this out of court as they have to have an attorney,if they are being sued. I hope this helps.

You should never give up. I know a lawyer who does this. He practiced on both sides. he is pretty good. he said it's very easy for people like us to win against big companies like walmart or madonal because jury feel sorry for us. let me know if you need his number.

On a personal note, I will not ever ever shop at a Walmart. I cannot stand their business practices (this is from a business standpoint). Your story does not surprise me at all.

I don't know a lawyer either.

HOWEVER, I have found when I have a complaint with a company, DO NOT GO AWAY. BOMBARD them with your paperwork, follow up and make an a-- out of yourself to management, etc. When most companies realize that you will not go away, they will negotiate something.

I did this with a company who would not refund my promised money. I continued to call, fax, mail and ended up with a FULL refund instead of the partial I was told I would get. Believe me, they did not want to see my number or name again and they won't.

Hang in there and be tough...

have you tried surfing the internet to see if others have had this problem with Wal Mart? There could be a class action law suit already out there or if there isn't you could initiate one and speak with a reputable attorney who would do the work and not get paid until the case settles.
You could also go to a blogs and blog about it - you may be surprised at the results; others would chime in and you could e-mail Wal Mart to show them that you've started that and you may be surprised at how responsive they suddenly are. . .mess with them a bit for free before you could possibly incur attorney charges on this.

You could try filing a small claims against them yourself. But first I would just work with WalMart... get to their District Manager and write a clear, short letter explaining the situation.

If you signed something authorizing the charges, with an estimate of the costs, chances are slim for you to recoup your money. But if you didn't sign anything and there was no written authorization, I would think you have a good chance of getting something back.
