Help with Non-custodial Parent and Taxes

my daugther father has claimed her on his taxes for the past four years and we go 50/50
of what he gets,but last year he only gave me like 30% of what he has gaven me in past years in one check and he said that when he gets his state checkhe would give me the rest of it, but he never did.cause his new girlfriend told him something.so this year i told him i would be claiming her and he said no that he is gonna do it...he does not pay child support or provide her with anything all he does is pick her up every other weekend and most times he has excuses why he can't come.

what should i do he does not deserve to get all that money from her?

OOOOOO Girl i can't believe you let him claim her. Don't you work? He don't pay you nothing and your giving him money for free! Who cares if he don'twant to claim her better for you. And another thing if you ever wanted child support you are screwing yourself because you are letting him claim her as though he takes care of her.. Think about it! and good luck..

I think you should file your taxes & claim her before he does. Then if he tries to claim her you can file a complaint, seeing as though you pay for all her needs & she lives with you full time. I also think you should get him to start paying child support. It seems, with certain men, that when they get new girlfriends they become, for lack of a better word, stupid. Good luck!!

WOW THATS A TUFF ONE , TRY TO FILE ,YOU HAVE TO GET YOUR PAPERS IN BEFORE HE DOES THATS THE ONLY WAY I KNOW,, IF YOU WANT TO GET NASTY ABOUT IT CALL THE IRS AND AND ASK THEM A HYPERTHETICAL QUESTION ABOUT CLAIMIMG CHILDREN ON YOUR INCOME TAXES.. THEN GO FROM THERE,,,,GOOD LUCK

hi M., when i felt separtated from my children father he was still active in there life so i let him claim the kids since i was on public assistance at that time but once i started working and paying everything for them cause he wouldnt want to help anymore. cause at that time his partner was telling him that he didnt have to help me if he wasnt in the household anyway. so when it came time to file taxes i told him no he couldnt claim them cause i has letters to prove that i paid for childcare, clothes and etc. even when i told him this he went ahead and did anyway, but when the letter came to me and him from the IRS to show who is doing what. i won and got my checks within the week and he didnt get anything in return. but if you paying for everything then claim her and let him deal with the after effects like i say.

I think that it is not fair how the father of your daughter get a full years check for your daughter when he is doing a part time job of taking care of her during the year... It is sad that the only time he want to claim to be a parent is during tax time.. I know you really don't want him to claim her but you can use the extra money he gets for her.. If you claim all three children am pretty sure you would'nt get that much on your own because it is three of them you would be claiming.. Maybe you should look into your mom claiming your daughter she is most liking helping more then the dad. I wish the father would play a more active role he will regret it later when your daughter is older and doesn't want to be bother with him.. This is the type of relationship I am sharing with my dad.

I guess my first question would be why is he claiming her? You say he doesn't pay child support. Regarding that why haven't you reported him and second does he buy her things when he is with her or just because and how much of it? I don't think he should have a right to claim her if he's not taking any real responsibilty for her. If he does insist on claiming her you should ask for more than 50% since he doesn't pay child support. Its obvious that the only reason he's claming her is to get back more and that's just not fair if you're not get the bigger amount.

well if he wants to hurt you or better said listen to the next women hit him where it hurts take him to court fot child support and then if the child lives with you and you support her then you have the right to claim her and when push comes to shove they going to be on your side b/c the child lives with you and he doesnt pay child support

Actually, the custodial parent has all rights to file for their child. You can file without any penalities if you provide more than 1/2 the support and living situation for your children. Regardless, if there are weekend visits with the father or he pays child support. Child support is not consider as income in regards to your taxes. You can't file as such and he can't file it as a expense. Scenario: If you both file at the same time and claim the children, IRS will get involve and whomever can prove they provide more than 1/2 the support and the child live with them for more than 1/2 the year, will not get hit with penalities. You can investigate this matter further if you go to www.irs.gov and speak with a rep as well.
