He's Trying to Take My Kids

My husband and I have been seperated for 3 yrs. now. I have had majority custody of them for 2+ of those years. During this time he has paid me no child support. about 1 1/2 yrs. ago he moved back to Philadelphia. He would see the children on breaks from school and I let them go to philly during the summer (to see him and their grandparents). He was supposed to return the kids to me by 8/4/07. He just now informed me that he was not going to do this. And if i come there he will have me removed from his property. B/c we are still married, it is not kidnapping. I don't know what my options are! And like i said i'm a single mother of 2, w/ no help. I don't really have the financial means to obtain an attorney. Any information you can give me on this would be EXTREMELY helpful. I love my children more than anything, I can not allow him to do this to me! What can I do?

It IS kidnapping even if you are married. The courts did not give him custody! You MUST first call the police!! Then you must call an attorney... there are attorneys out there who will help you! Call a local church and tel them your story and see if they can give you money (I know a lady who did this and she got all of her bills paid). DO NOT let him steal your children. If you let him keep them, when you do file for divorce, you may not get custody!! DO NOT let not having the money STOP you! Call SPARCC, call EVERYONE you have to!!! FIND a way to get your boys back!

it is kidnapping, even legally, so don't go under that false assumption. As someone else suggested you can both county police and you drive yourself to a lawyer right now. Money is the last thing you should worry about right now, it will work itself out!

Many divorce attorneys will take your case with no retainer required up front. Judging by your story, you should be able to find someone who will be more than willing to handle this situation and get your kids back quickly...in time for school. Make a few phone calls and see what you can do. Good luck!

I am so sorry and I wish I was an expert, or knew one, to help you. If it were me, I'd be calling authorities in Philly *and* the Manatee County Sheriff. Ask them what you can do and I'll bet they do something or point you in the right direction. (The Manatee County Sheriff's office handles all Department of Children and Families complaints & can coordinate with authorities elsewhere in the US.) Irrespective of your spouse being a parent, you have an agreement and he's violating it. He has the children out of your custody and removed from their home state. I'm sure something can be done. Like the previous mom wrote, there are attorneys who take on a case without a retainer. Get moving on this mama.
