Has Any One Ever Been Sued by a Former Landlord?

My two daughters and I moved out of a rental house in Roseville this past June. I was just served a affidavit for small claims court against me from my former landlord. He is claiming damages to the home, unpaid house bills (wich is a water bill). I know of only two damages that were caused by us there were holes in the walls wich I left a half a sheet of dry wall for him ( was unable to do the repairs myself) I am worried however that he is going to blame us for preexsiting damages that were there when we moved in. I was not able to do a decent clean up of the home. FIA made me move out asap because it was discovered that he was a convicted pediofile. I need some advice and wondering who I f anyone I can contact I have an attourney through the legal aid system right now for some other things. Any advice would be a big help.

So What Happened?

Well the lovely ex landlord put me through all that only to protect his lovely money. We ended up in court twice. The judge found in his favor the first time and I appealed the decision. My ex landlord took me aside before the hearing started and told me the reason he took me to court to begin with was only to make sure I did not try and get my security deposit back!!!!!! I knew he wasn't going to give it back to me in the first place when I moved so I went through all that stress and chaos for basically nothing. He collected nothing and spent money to file the case and I spent money to file the appeal. He knows I am not collectable I have no money to collect on. So we went our separate ways money spent and he knows that I wont try to get my security deposit. Thanks for all the advice you all gave me here.

Did you keep a copy of the inspection sheet you should have been given to fill out when you moved in? You should be able to provide it to the court. If he is a convicted pedofile he may not have been allowed to rent to you...I would argue that that voids any damages you may owe.

You cannot have an attorney in small claims court (neither can your landlord).

Find out if the home was a legal rental....call Roseville city and see if an inspection was done to the home, if not, he can get in trouble for renting

Hi J.,
Me and my son had the same problem when we moved out of our apartment in Southfield. We made a list of the damages that were there when we moved in but they still came after us with some of the damages that were on our list that we gave to them. Unfortunately my son paid them (he's 25) and they still kep the deposit. I would suggest reporting him to the landlord & tenants rights agency and they will appoint you an attorney that specializes in that field. Good luck, let me know how it turns out. Call the law department in the city county building and they can advise you on who to go to next.
