Eviction...Two Kids, Pregnant and Only Have 2 Days Until Evication Help!

Hi, I agree with the other posts. They may start the eviction process on 8/15 but it is a lengthy process and may take a couple months to be at the point where they can physically remove you.

I hate to even mention it because they are sharks when it comes to interest...but have you considered a PayDay Loan? If you are only having an issue because of the payday switch, this might be the temporary solution.

I would never recommend them to anyone for anything...but it seems that you are only 5 days short. Pay it back immediately and never do it again.

Do not, do not, DO NOT, I repeat, DO NOT use a payday loan. No matter how desperate you are, these places are pure evil and your problems will only get worse.

I'm so sorry that you are going through this, but I also wanted to chime in that Catholic Charities is a great place to start. Check local food banks, too and I agree with the others- don't get packing yet. Google the laws in your area, knowledge is power so educate yourself!

Don't make any plans to pack up and leave! Your landlord cannot evict you immediately. My brother is an attorney, and he has always said eviction is the longest process! Make sure to relay to your landlord that you will pay in full in 30 more days. Until then, eat lots of breakfasts for dinner, it's cheap and filling and healthy and you will save some money on groceries! :)
Most importantly, stay strong for your kids and tell your husband that this is certainly not the worse thing that could've happened. You all still have your health and are looking forward to a new addition! God bless.

Secondly, I am a landlord and understand the hard times my tenants encounter, so I often suggest that they get help with their rent. There are organizations here like St. Vincent DePaul and various housing programs that offer temporary assitance to families to only need help as a one time payment. These places of assistance need the three day notice as proof of need, so as long as you have one from your landlord, I would call your local housing chapter and ask them to direct you in a direction of where to find need.

Problem is that it's Friday... the 15 is on Sunday! I guarentee the eviction will NOT happen on a Sunday and you will receive a 24 hour notice to move from the sherrif (at least that's how it is here in FL)

I would do everything I could to get assistance for this month and give all proof to the landlord TODAY (If a shelter offers some assistance, they will need the landlord to fillout the forms in order for you to get the assistance- Landlords usually don't turn away help in this manner, because it's a guarenteed payment.)

In todays tough times, I don't see how your landlord would benefit from not taking A LEAST a partial monthly payment until you get back on your feet.

Swtiching sides now, being a landlord is a business. We have mortgage and bills to pay that comes from our tenants rent. If the tenants don't pay, we have to take out of our pockets, diminishing the purpose of the initial investment. Therefore, we have to follow procedure to get the most out of our investment...

That being said.. I am a human and I understand and BELIEVE IN helping others, in hopes that I will get help if I should need it one day. If you screw me over once, however, you won't get another shot with me.

I hope your landlord is supportive and will give you a bit more time before evicting you.

And to comment on below comment... Eviction will be started when filed, but the actual eviction takes upwards of a month to finalize (at least here in FL). NOT that you want an eviction on your record, becasue then you'll have a harder time finding a new place to rent... perhaps having higher deposits and what not.

You said you've all ready gotten help with food, from who? If you had applied for food stamps they would have also checked to see if you needed anymore emergency assistance. Call your case worker they can help with utilitys,rent, section 8 housing and more. There's also catholic charities.

I am not an expert on this by any means but I have witnessed several people go through evictions in the surrounding duplexes and no, eviction is a lengthy process and most landlords would rather get rent late then have to go through eviction proceedings. Talk to your landlord, offer to pay them whatever you can now, I think even if you did face going to court they give you an oppertunity to "Pay or quit" which means you could pay the past due rent and not be evicted.
Have you gone to the salvation army? They can give assistance towards bills.
Lots of luck, I would honestly think talking to the landlord would be your best bet.

You should have a little time. I can't imagine him serving you notice for August rent before August is even out. Once he serves you a notice, it will be a 5 day demand letter. After 5 days, he will then have to go to court to file an eviction.

But, you need to get help fast. I did a quick Google and found this:

have you researched eviction laws in your state? my husband used to be a police officer and different states have different eviction laws -- some states can start the eviction process but you won't be physically removed from the property for a while...so sorry you're going through this...will keep you in my prayers :(

I agree with Kate. Catholic Social Services are very helpful if you contact them through any catholic church. You don't have to be Catholic to ask for help.

I'm also a landlord and I will tell you that we have had several tenants who had difficulty with their rent. As long as they were paying SOMETHING we never evicted anyone. I have a hard time believing that someone would evict you because pay periods were switched one month at your husband's job. It usually takes several months of non-payment before someone can be evicted. Have you talked to your landlords personally? Can you set up a payment plan to make small payments to catch up? Oh you poor thing! My heart goes out to you and if I won the lotto I would help you! Right now all I have is prayer, and I will keep you in mine. In the mean time, I believe that the eviction process takes a long time. Stay put right now. Check out the laws in AZ on eviction. There is also legal aid in AZ that may be able to help provide you with your tenant rights.

This will be weird advice, but here goes: Have you considered sitting back, relaxing, and telling your husband (confidently!) that you trust him to take care of this? You are taking care of two kids and pregnant with #3 - you are already doing a full-time job, and it is not good for you to be super-stressed out. In my life I have noticed that my husband only steps up to the plate to do his job (of caring for our family and meeting our needs) when I graciously step out and let him - and let him know that I won't be getting involved. When I stress out and take the reigns, he steps back and lets me do the work. This may go against feminist-thought, but I have really seen it work. Try "The Surrendered Wife" for further thoughts. When I have something big in our life, I say, "Hon, I can't handle X and I trust you completely to take care of it. Thank you so much. I love you." Then no nagging, no reminding, no getting in his way - and he has a much better likelihood of stepping up and taking care of the issue, no matter how big. Men want to take care of their families, but they tend to retire quietly if the wife takes over. Just a random thought - best wishes to you!

If you have paid up through july, they will only start eviction proceedings on 8/15. They can't just throw you out. You generally have to go to court, etc, and for a lot of people it takes several weeks to be evicted.

It takes at least 3 weeks for them to evict you and that is if they get a court date right away. I would go to the court and ask around about what you can do to forestall the proceedings. Ask if a notarized letter from your employer about reimbursement would be acceptable. Be visible and ask questions. Show up for all court dates, etc. hth!

Don't move out. As stated earlier, a real eviction process takes a very long time. If you are really only one month late, your landlord will have to file for eviction, etc..... In California, this takes a long time. Please check what your renters' rights are in AZ. I am sure that they are pro renter.

We were resident managers in college and had to evict someone and it took forever (like 3 months maybe more; it was 20 years ago).

Call catholic charities. You don't have to be catholic. If you are on foodstamps, call your case worker. They would know of every available resource for help. Worse case scenerio, if your landlord would happen to give you an eviction notice, the notice would say you have 30 days to pay up or be removed from the property. That would give you 30 days to find a solution. I am not 100% sure about that, I have never been evicted, but I believe that is how the law works. I am pretty sure they have to give you 30 days. Look in the phone book or online for community outreach services in your area. Call every church in the phone book. The best thing you can do is be proactive, and I am sure someone will help you. The evitction process takes a while, your husband will probably get paid before you even have to go to court. You will have to pay a large amount out of that check to get caught up but I think you'll be fine. I would also write your apt complex a letter explaining your situation and let them know they will get all funds on Sept 20th.
Please do not do the payday advances someone suggested. It's an evil cycle you'll get caught up in and put you in a worse situation than you're already in. Good luck!

I second the advice of trying to get a personal loan from a bank or title loan place, something like that. Since your husband does have a job it shouldn't be that hard as long as your credit is OK. Also, maybe try to find a tenant hotline, I don't think they can actually kick you out yet. It's only this months rent right? They may have to go through the court system first. I second Melissa B's post, but we faced being evicted two months ago and that evil B**** of a lady (she had her tampons shoved up to high or something because she made up things about us) but she pushed the courts to have the hearing in a month. Sooo it can take a while, but if you have an evil landlord like our last one it could be less. FYI

Do some research. Know your rights. You cannot be evicted without a court order.

a lot of times you can go through the social service agency that does welfare and food stamps and get a one time assistance depending on what the programs in your area offer. Also, I think someone else mentioned shelters or other programs that will also offer one time assistance. Since I'm not in your state or area, I don't have specific information but try calling some of the homeless shelters or go through social services, however social services process may not be able to help you in the little time you have.

Try Catholic Social Services or your local Catholic church. They'll help you. Good luck!

So sorry you are going through this.We have been there when my husband started his own company.... We were in the different state,6 hours away from family and friends and too had 2 kids. Unfortunatly we had to move in with my inlaws for 3 months . Since you know that you will be getting the money....it is different and only 2 days....wow. Most big churches have funds to help people with rent/bills, but you have to apply and it takes AWILE, so it will not work for you (you can still try though, just call big churches around). Can your friends/family wire you some money????

If nothing will work you might want to check some shelters(we have worked in the shelter for 2 years after getting married and lived there in the back room......it is not that bad)

JM - I am up in Washington so am not sure what your options are in AZ. But, up here we have an organization called Hopelink where they are a food bank, help you get set up with bills getting paid and can help you to pay your rent if you are being evicted. Try and call your state's benefits line and see if there is a way for them to give you the number to a local agency that can help you. I do not know if you are involved with a church, but if you are just go straight in and explain what the issue is. Make sure you always bring your eviction notice with you! Especially if you go to a church that is not usually yours, they will want to make sure you are not scamming them. I even went to our local police dept and met with the chaplin there, years ago, and they gave us money to our local grocery store and gas station.
It sucks when you are going through a financial crisis! We have been there too. But, you have to swallow your pride and just start asking everywhere.
I would say to first look up at your local food bank and see if they can set you in the right direction. (I only know this because I volunteered at one!)

I just want to add for others in this situation that nearly all the payday loan places in AZ have closed because they are no longer allowed to offer high-interest loans. I would also suggest that anyone in need of help to contact the Catholic church in their area, as several in the Valley have ministries to assist families in their area. Many also have additional ministries to help pregnant women, and if they can't help they will usually try to direct you somewhere that can help.

Have you tried those quick cash type places that seem to be on every corner? I've heard they give you advances on your paychecks and just about anyone can walk in off the street and get quick loans at those places, no matter what your credit situation is. I've also heard they charge extremely high interest rates so I'd be careful to pay it bck asap, but beats being evicted??

I'm not an expert by any means but an eviction is a legal process. You cannot be thrown out onto the street. They have to begin proceedings and I believe there is a hearing, but I could be mistaken. You need to know your rights as a tenant. There are laws and you need to read up on the laws to make sure that YOU are in compliance as well as the landlord.

So, let's say that you have a stay or brief reprieve. My recommendation is to try to get the funds from somewhere or if you do have to move before your husband gets paid, on the 20 Sept., put your stuff into storage. You will recover. You will be okay. Get a month to month rental, or week to week or stay in a shelter if you cannot stay with a friend. But remember: There is a process the landlord has to follow. Know your rights. Know their rights.

I've read some of the posts. Bottom line if you are not over 3 months late just let it roll till your hubs gets paid. Your LL has to go to court and even if he gets a date prior to you being 3 months late just go to court with a letter from your husband's employer stating the money he is getting paid and the release date and trust me the judge will be looking at your LL as a waste of time and will tell him to back off. This happened once to me, in my 20's, I wasn't past a month and my LL decided he wanted to evict. By the time the court case came up I was there with the check and the judge asked me if I had any requests and I said my apt could use a paint job and I have a cracked window. The judge gave my LL 3 days to comply. Oh, glorious victory!! You will be fine and you WILL NOT be thrown on the street.
