Hello all,
I am turning to you ladies becasue you have helped in the past with ideas! My sister told me the other day that she has been taking money from her employer for about the past year totaling $6000! I was floored as she is a great person. There are a lot of factors that go into it, and I don't make excuses but I know my sister and she was desperate. Anyway, she can't hide it any longer and it WILL come out Monday. This is the first time she has really been in trouble with the law. Does anyone know with a first time offense what she can expect? I wish I could help her, I feel terrible for her. I am going to our church tomorrow to meet with the Care Pastor for some guidance. Please be nice, this is my sister.....

It would be larceny. There are many types of larceny-theft offenses. A person commits the crime of larceny-theft if he or she takes and carries away the personal property of another without consent and with the intent to steal.

Embezzlement (O. type of larceny) is a low-profile crime that typically consists of employees of organizations stealing large amounts of money over a long period of time. Embezzlement is usually defined under individual state statutes dealing with grand theft. Generally speaking, however, it can be described as a fraudulent appropriation of property by a person to whom that property has been entrusted. The element of trust is critical in establishing the crime of embezzlement.

She might want to talk to an attorney and see if it would behoove her to come clean with them before Monday, right?

I don't know the law ramifications, but I think that if it's coming out on Monday, her best bet is to go in to her boss NOW, with a check for part or all of the money in repayment, and confess. Have her offer to resign from the job, and make a plan to pay the money back with interest. Do it now--don't wait until it's discovered on Monday. She should also contact a lawyer as soon as possible, because she may well need a criminal attorney.

The best thing to do is to pay the money back and ask for forgiveness BEFORE it is discovered. Contact a Lawyer.

Stealing $6000 is a felony. AND if she stole it $400 at a time its multiple felonies. If she stole 15 checks of $400 each she could get 15 sentences to serve one after another. That could mount up to 75 years if the theft penalty is 5 years per occurance.

Hopefully she will never do it again.

Good luck to you and yours.

It's still Friday so if it'll come out Monday anyway, it's always viewed better to turn yourself in... Maybe she can preempt the police getting involved if she goes to her employer, confesses and comes up with a plan to pay the money back.

I feel for you. My brother did the same thing a couple of years ago in NY. First things first, she needs a lawyer before she says one word to anyone. My brother didn't and confessed. He had the book thrown at him and was sentenced to 5-8 years in minimum security for a felony.

She needs a lawyer now, before this comes down. PLEASE if there is anything I can get across she needs to get that lawyer before anything happens.

My brother is a great guy and he did his out of desperation too, but that does not matter when you are dealing with these things. If you want more info you can send me a PM and I can tell you more about what happened with us.

I know a woman who embezzled $30,000 via checks paid to herself from her employer, a local government office. Her dad went in and had a check, with interest, ready to pay on the spot. she resigned, he paid the money, and no charges were filed.
Of course, being a small town, we ALL know about it.

She will need a lawyer. Even if she confesses her embezzlement there are consequences and in this tough economic time $6,000 is a lot of money for many. Be supportive and understand that in this country she is innocent until proven guilty and the prosecution must prove that beyond a reasonable doubt. She really needs to figure out how she will repay the money she has stolen even if the company doesn't prosecute. That is the right thing to do.

Be supportive of your sister during this rough time in her life. I'll be praying for her and you too and the entire family. So many people impacted by her moment of weakness but there for the grace of God it could have been me.

You are on the right track, pray.

I haven't checked the statutory limit for felony since high school. At that point it was $5,000 so there is a good chance she is up a small natural stream of water without the proper means of locomotion.

Sorry

My dad always said don't judge those that steal, sometimes it is only that you haven't been in their situation that you choose not to. Still pisses me off when people take from me but it helps a little in the grand scheme of things.

Attorney...Attorney asap! Hopefully, she won't be prosecuted by her employer but she can expect to lose her job and of course will need to pay the money back. I pray for leniency and I am sorry she got herself into this situation.

She needs an attorney NOW! This is a felony since it is over $5,000 and depending how she did it, it could be multiple felonies. I'm sorry your family is going to have to go through this and it will get very bumpy. My husband had a friend who did something on a bit larger scale and spent three years in federal prision. He was not allowed to work in his industry again.

I don't know if she is married but the marriage might suffer so she will need help on all fronts.
