hi
i am newly divorced and my kids are 12 and 18 my 18 year old doesn't have anything to do with dad and he didn't fight that request
my 12 year old obviously has no rights and my x makes his life and mine
miserable....does anyone have experience with this
any legal advice the divorce cost 15k and and he just filed bankruptcy to live with his girlfriend and my son doesn't want to spend weekends in their love nest..help????

I had a friend in a similar situation when her daughter was 11. The daughter told the judge how she felt and why and it was determined that she could see her dad when SHE wanted to, but she was not obligated to go. It was hard for her to say that in court in front of her father, but it was the truth, so she did.

If I recall correctly, my friend got her daughter in counseling so that she could discuss her feelings with an adult other than her parents. The added support helped with issues like these.

Actually, I'm pretty sure that at age 12 children ARE granted some legal rights when involved in family court. I would double check that...but I'm pretty sure it's at 12.

Also, so long as there isn't any legal custody/visitation schedule, nobody HAS to do anything. If the kid doesn't want to go, don't bring him.

If it starts to get heated, make sure the court knows you find his father's house unacceptable for children.

At the age of 12 the judge should take your son's feelings into consideration and you really don't need a lawyer for visitation matters in court.

Your youngest son doesn't have to stay overnight in the house with the girlfriend and you can fight that in court. The judge usually looks down on overnights with unrelated females. Just pray they don't get married like my x did, thats when the fun really begins.
