Question:
My husband fits criteria for a class action law suit. We recieved paperwork today showing attorney would retain 40% of winnings. Is this "the going rate" Any advise would b appreciated.

So What Happened?

This is in response to a medication he was prescribed. This medication gave him lif long side effects!

Call the attorney and find out...find out how much they are suing for, how many people have entered the class action and so forth - you don't say what the lawsuit is over and you don't give us a lot of information.

40% of a class action - well, depends upon the class action and how much they are suing for and how many people join the lawsuit...

You aren't looking for the attorney's "rates" you are looking for the amount of the class action and how many people are included in the suit....

Usually I hear it's 30%. It seems like everyone wants to take 'more' money in this devistated economy and it doesn't make sense.
I think different law firms have their own percentage rate at what they get if they win. Some are less than 40%.
See if there is another attorney that will take less. Good luck with your law suit.

When I worked for a personal injury attorney 9 years ago, we took 33 1/3% if we didn't go to court and 40% if we did have to go to trial. Also see if the 40% includes costs (copying, records requests, expert testimony, etc). We charged 40% of the settlement plus costs, so often times clients walked away with less than 50% of the settlement

I would say that's about right ... with as many ppl and as much work they do on these they charge pretty high fees other wise there would be nothing in it for them.

I normally see like 30 but if it's a class action then 40 is probably legit, you might as well join because since the judge issued a lawyer rights to a class action that means you can't just go sue on your own.. You don't really have much to loose and it's pretty much your only option (from what I understand).. You may not walk away with much but it's more than nothing.

40% sounds about right, though it is sometimes a third or up to 50%.

Yes, that's why these are so popular now days. The attorneys only need one or two a year to have a whole years income. You could receive millions.

The thing about class action means that a lot of people will get a lot of money but they go on for years and years.

My friend that had the bladder sling issue is still waiting on money. The company has the right to appeal it x amount of times, they always do it too.
