Can Babysitter Refuse Treatment for Child

My 3 month old daughter was riding with her babysitter and they were involved in an accident. The babysitter refused treatment for my daughter when asked by emt. I wasn't notified until I called babysitter 2 hours after acident happened. Can she legally refuse for my daughter to be taken to hospital? And should I have been notified by police or emt?

Actually, there was no one there who COULD consent to any medical treatment barring life-saving measures. The ER doctors could have only done what was necessary to save her life without the consent of either you or her father. So, I guess by extension, the babysitter can refuse treatment.

Id be more concerned about the babysitter's inability to respond appropriately during an emergency incident. She should not have refused treatment, and she should have called you immediately at the accident sight. I would let her go, regardless of who's fault the accident was....it is possible she did not want you to know about the accident. What if something else happens?

The only way that she should have been able to do that US if she has written permission from you. They the police or ems should have contacted you about treatment. I would never ever let her take my child anywhere again!! 2 hrs before she contacted you no way!!

Oh I would not be happy with the babysitter. She should have called you immediately and asked if you would like the baby treated or not.

The only way she could refuse treatment was if she had written permission from you, the MOTHER. I wonder if she told them she was the mom to avoid contacting you.

Hi, S.:

What were the expectations you gave to the babysitter when she took the job?

Did you have them written down for her to follow

For example:

Do not take my child out in the car.
If you have any questions or concerns about
health and safety, call me immediately.

etc.

If you didn't have a set of expectations then you need
to sit down and write up some with her present.

The frontal lobe does not develop until 25 years of age.
You need to set down rules for young people because
they are not able to reason things out like an adult.

People get babysitters because they are young and inexpensive to hire.

You need to take responsibility for the care of your 3 month old.
