Bought Crib on Craigslist, Missing Parts, Seller Won't Call, Any Legal Recourse?

Hello,
So my sad tale...I bought a baby crib from girl on craigslist who assured me that it was all in working order, all pieces were there, etc. Additionally, all the pieces appeared to be there when I picked it up and paid cash. Unfortunately it's missing a "stabilization bar" and two rubber stoppers & the screws that attach the stoppers, which I believe hold up the drop side when you lower it. Can't put the crib together in it's current state. The girl seemed very nice at the time we met and assured me that I could contact her if I needed anything further, etc. The very next day I called her to request the missing pieces. She waited about a week to get back to me but finally emailed saying that she was sorry and she would find the pieces. Now it's been another week and I've heard nothing. I know it's probably a lost cause, but does anyone know if I have any legal recourse at all? Thanks.

What can I do next?

The crib probably has vendor info on it, or the craigslist ad probably tells what brad/style it is. Ours had missing parts (very common for cribs being pulled out of storage) and we just googled crib part manufacturers. We described what kind of crib it was, what part was missing and they knew exactly what it was. We bought the part and it got shipped to us.

Not sure what you paid for the crib, but you could always take that person to small claims assuming you have her name/details to serve her papers on. And, I would threaten her with such as well. Perhaps that would make her respond in a responsible manner. As a mother herself, she should understand and knowingly refund your money knowing first hand that you want only the safest and best sleeping conditions for your own child. Shame on her for not doing so already. I would honestly show up on her doorstep and leave the stuff there as well and demand such refund too. Well, maybe that will be ugly? Did her ad say anthing like "as-is" etc? If her ad misrepresented the quality of the merchandise I see no reason why you couldn't take her to small claims for selling something inaccurate to what she depicted it as in her ad. Best of luck, and so sorry for your troubles.......

First, I would check and see if the crib had been recalled. I recently discovered that the crib I used for my first baby had been recalled. The manufacturer requested that I send in the stabilization bar and round bumpers in addition to the label that had the crib model number on it. I also had to sign a statement that said I would not resell the crib and would dispose of it properly in return for a voucher for a new crib. If it is a recalled crib I would think that you might have some recourse. If it's not recalled but missing pieces, the manufacturer should be able to help you. Best of luck!

Sorry about your mishap with Craig's list. You know it is a lot like Ebay. You never really know what your getting till you get it. But the only legal action you can take against her is to take her to civil court. I have been a police officer for about five years and we always have people who run into these types of problems. The reason it is civil, is because basically you and the girl made an agreement. (You pay her and she gives you an item.)It is called an unwritten contract or verbal contract. The sad thing is, that it will probably cost you more to take her to court than what the bed is worth and your time. You will have better luck if you look the company up online and order the parts you are missing and just use this as a "lesson learned". I don't know about Craig's list, but if it is like Ebay, you can write her a bad recommendation for future purchases so that everybody can read and will know. Good luck and once again sorry about your mishap.

contact the manufacturer!! they will more than likely send you the missing parts free!! If they do charge it will be a very small price--beats waiting around for someone else!

I have heard of people selling recalled cribs...They send the screws in to get the refund and then sell the rest as a crib in a garage sell. I would think if it was a recalled crib then you could muster up a lawsuit. If I were on a jury I would totally side with you.

unfortunately, no there aren't any legal recourses you can take against them. Since there isn't a written garuntee from them, it kinda messes that up. But, i would call the company that made the crib, we bought one off craigslist that was missing a few peices, and the company sent us the peices for free.

C.,
I am sorry about your situation. I wish I could help. I did get a crib from my sister that was missing the stabilization bar and some screws. I contacted the maker of the crib (it was on the side of the crib on a plate with contact information and the model of the crib) and requested the missing parts. They sent them to me with the instruction manual that I needed also. I had to pay for shipping but the crib is as good as new.
I hope this helps.

Like the others, I can't help with recourse, but you can try productsamerica.com for the missing parts. They have crib parts and parts for other baby products.

Unfortunately. I doubt you have any recourse, but you might be able to get the missing parts from the manufacturer. I had to go that route for something I purchased a whule back.
