I plan on doing a garage sale in early June. I can't wait to get rid of all my junk!
I have also been working on my cupcake baking. My mom and I want to get good at it...possibly to open our own shop one day if we do get good at it :) So I was thinking that at my garage sale I could bake up some cupcakes and sell them at the garage sale. Does anyone know if this is legal? Or does it vary by town? Just wondering if anyone has done anything like this before. Thanks!

So What Happened?

Thanks for all your input. I think that I will check with the village BEFORE I do this! God forbid I end up doing this and a cop pulls up and tickets me! If they tell me to donate, I have a great non-profit organization I can donate to. Thanks for all the great answers!

Technically, it is against the law (FDA, Dept. of Health, OSHA)...that being said...All those bake sales for charity events are also skirting the laws. You should actually be inspected and licensed as a commercial grade kitchen before making food for sale, ever...but everyone does it. Heck, even those cute little kids selling lemonade in their driveway are not doing so legally. I would do it and plead ignorance.

I agree, do it as a Charity Bake Sale. All of the profits go to your favorite charity, but at least it gets your name out there.Maybe take names and emails so you can start a contact list for when you do start your business.

Before you start baking out of your home for profit...
Be sure to take a food handlers class so you can be licensed at home .. Look into renting a commercial kitchen or be prepared for the health dept. to inspect your kitchen if you really want to get into the business out of your home.

FYI, a very good friend of mine has always wanted to own a pie shop. She started off in a food trailer.. she rented time out of a bakery for the baking, then she transported them and sold her pies for 2 years from her trailer. Yesterday was the grand opening of her actual shop! I am on my way over to purchase pies and deliver them as birthday gifts!

It is illegal where I live, but nowadays that seems the norm for a yardsale. But, frankly, I don't buy ANY homemade goodies, 'cause you never know what their kitchen looks, or where their hands have been or if they washed them.

I don't think it is? My neighbor down the street did that last year while she was having her garage sale, her kid's were the one's that sold them. I also see alot of people selling iced tea and lemonade at garage sale's too. You gotta figure that the majority of people coming to your garage sale are probably people in your area. I was planning on having my kid's do a bake sale and have them donate the profits to a local chairity. I also know that when we had our garage sale last summer we had to go to the city township to get permission to have one, they gave us a sheet stating that it was ok for us to have a garage sale. If your planning on doing that then just bring it to their attention to see what they say. But I personally don't see anything wrong with it. If I were to go to a garage sale and see that they were selling cupcake's I would definately buy some! Good Luck and have fun!

Call your town anonymously and ask. If anyone stops you, just ask like you had no idea and just stop.

Why not donate the proceeds?

Put a nice sign on the table
Cupcakes by (Your Name) to benefit (Church, school, shelter, etc)

I think this is a great idea! To HELL with laws, tehehehe!
