Hi everyone--I have a 21 month old son and another little boy on the way, due in April. Our neighbors downstairs smoke A LOT and it is really bothering our little family! It's totally disgusting and not only making our apartment stink, but it makes me feel sick! My first question: does anyone know of any "tenants rights" to breath clean air? Or is our only option to move...if so, how do we find a non-smoking apartment??? I have been looking, but can't find any info. about this. I just really don't want to bring my new baby into this smoke-house!!! AUGH! P.S. another little complication: We can't afford more than $600.00 a month. THANKS for any insight!

What can I do next?

So What Happened?

Well, I wanted to thank everyone for the help! We are still in our smoky apartment, but we are trying to come up with a plan to at least have as clean air as possible while we still have to be here...with air purifiers, etc. Just a few months and our lease is up, so we are hoping we can cope till then!

i would look for a duplex to rent 1/2 of or something like that. I know that many smaller landlords don't want damage done to their places, or the risk of fire, so they don't allow smoking. I used to own a duplex, and didn't allow smoking in the units.

Good luck!

Yes there are some near downtown Columbus, however the cost is way above $600.00. Tenant rights really don't apply to this as Columbus has not passed the law here like in CA about smoking in the home. My suggestion would be to talk to your neighbor or put some hepa filters that you can purchase at lowe's over your vents until you can find a new unit.
Good Luck

My husband and I own several houses that we rent. If you are considering moving, what are your requirements? (how soon, what area of town, #of bedrooms, garage, etc.)

I would see if perhaps there is another apartment that is nearby that you could take your time moving into. Or talk to the rental office and see if perhaps they could do something. A lot of places have rules about not smoking inside, but you can outside, which to me seems perfectly reasonable--probably b/c I am a non-smoker. But, it's hazardous to your health and the health of your family, including the baby on the way. There would have to be something the rental office can do, even if it's saying "our buildings are non smoking, and if you want to smoke can you please do it outside". Start there, and see where you end up. What rental property owns the apartments where you live? See if perhaps they have a corporate office nearby where you can address the issue further if necessary. The last thing they are going to want is a lawsuit on their hands!
