Many of you are asking about the reason for me wanting to pursue anything? More than anything I guess it would be because of expenses. I did not have insurance on my child. I unfortunately was just switching him from one to another at the time and didn't plan accordingly, long story short, I am stuck with the bills. However, I do have very bad credit (from a time my husband was out of work) and was actually comtemplating on filing bankruptcy to begin with. I would assume I could include these medical bills in the bankruptcy then. So basically, nothing good would really come of moving forth with any legal actions- correct?

So essentially, you have creditors after you right now? Yes, even if you received a settlement, any outstanding bills you have would confiscate anything you receive. Please, there is legal aid available NOT for suing the school but for unwinding your financial mess. By not having insurance on your child and by not managing your finances, you end up screwing the rest of us who do pay our bills. Talk to the school about having their insurance cover him, but don't expect it to happen and don't sour the work situation you have. You can't afford to lose your job.

I'm sorry. My husband was unemployed for 10 months. We maintained insurance.

I don't often read ahead, but I did on this...I have to agree with Veruca 100%. Lack of planning does not constitute an emergency on my part.

The school should have insurance. File a complaint and get your son's bills from this accident taken care of.

If you were looking for fast money to resolve your financial problems? Not gonna help. If you have any liens or anything like that? The money will most likely go towards the creditors with the liens.

I echo what Wild Woman said - it's probably worth checking into whether or not the school district's insurance will cover this without a huge fight. Anything above and beyond getting your expenses covered wouldn't make sense because it would be seized by your creditors. At the end of the day, sure, you should have had insurance but on the other hand, if they weren't following their own rules for teacher:child ratios and enforcing safe play on the playground, then their negligence shouldn't literally cost you.

I read your other post earlier but I wasn't exactly sure what advice to give. However, since you don't have insurance, you can ask the school if the could cover the expenses for the accident, esp since there was some negligence in supervision. If they don't, then I guess you have no other recourse than to hire an attorney ($$$) or assume the bills in your bankruptcy.
You have to know you are SO lucky in this case. He could have had way more serious injuries. This could have happened off school grounds. Kids will be kids, but adults should be responsible adults. That goes for the teachers that should have been supervising, and you for not having your child properly covered with insurance.

I guess lesson learned here. Never let insurance lapse. I would just suck it up and pay the bills and chalk it up to life! You need your job so you cannot afford to create waves.

Most hospitals have some kind of financial assistance for just this sort of occasion. We have used it before for both myself and my husband. It is based on your income. So I am assuming that if you are contemplating bankrupcy and have bad credit that you qualify income wise.
Trying to get a windfall from the school to pay off your bills doesn't sit well with me. Especially if the hospital will probably write off your kid's bill.
ANd if you haven't looked into it already you should get your kid some health care. Again, through the state if you income qualify and it's free.

Your school will have insurance for such things. It pays only the cost directly related to the break. Talk to the principal tomorrow. I am surprised she didn't go with you to the hospital and make plans for the district to pay.

Note, if you receive anything beyond medical bills from them, it will go in trust for your child until he/she reaches 18.

I haven't read all of your responses, but you definitely need to have the school fill out an accident report asap. Then that will go to the district office. You then can get the contact info of the finance person who can find out if there is anything they can do to help compensate you for the injury on school grounds. We had a similar incident happen to my daughter and the school covered all medical bills. We are in the same boat currently after my son was recently injured by another child and needs extensive dental treatment. So, follow up with your Principal and get an accident report filed. They should have already suggested that.

I would check with an attorney about sending a letter asking the school district to cover all current and future medical expenses related to this injury. As for any settlement it would be best to have it put under your son's name for his expenses. This would protect it from your creditors and it should ONLY be for your son's use (college education, etc.)

B., actually, I think that the school has the children insured for accidents on the school grounds. You should actually ask the school's insurance to cover him.
